MAX / LEGAL
Design & Intellectual Property
We safeguard our original design and engineering work through an integrated system of registrations, copyright, trade-secret controls, contracts and protection against unfair competition.
Scope of protection
To the extent protected by their nature and the applicable legal requirements, the scope covers assets owned or lawfully used by MAX Lighting: the complete and partial appearance of all lighting products, product families, housings and optical components; injection moulds and mould geometries; PCB layouts, circuit diagrams, software and technical solutions embodying operating principles; technologies, heat-sink and thermal-management designs; packaging, technical drawings, CAD files, prototypes, catalogues, photographs, renders and animations; the MAX Lighting name, logos, graphic language, copy and all other original design and engineering outputs.
Layered legal protection
Depending on the asset, protection may arise through registered or unregistered design rights, patents, utility models and trademarks under Turkish Industrial Property Code No. 6769; copyright under Law No. 5846 on Intellectual and Artistic Works; the unfair-competition provisions of Turkish Commercial Code No. 6102; and trade-secret, contractual and applicable international rules. Applications, registrations and rights-management procedures are pursued in Türkiye and relevant target markets where appropriate.
Technical information and trade secrets
Non-public PCB topologies and operating principles, bills of materials, manufacturing tolerances, thermal analyses, mould and prototype information, testing and production methods, supplier specifications and know-how are managed as confidential technical and commercial information. Access is restricted, and disclosure is governed by confidentiality agreements, intellectual-property clauses, authorisation records and version-controlled digital archives.
Unauthorised use and imitation
Subject to exceptions expressly permitted by law, no one may, without prior written authorisation, copy, reproduce, adapt, scan or model the protected material; manufacture or commission manufacture, offer, sell, import, export or otherwise exploit it commercially; obtain technical information through unlawful reverse engineering; remove or alter rights notices; or use confusingly similar logos, visual language, product appearances or packaging.
Records, monitoring and enforcement
Design and development work is documented through dated sketches, technical drawings, CAD and manufacturing files, prototypes, test records, version archives, contracts and registration documents. MAX Lighting monitors markets, digital channels and industry platforms. Where infringement is identified, available measures may include preservation of evidence, cease-and-desist and takedown procedures, interim relief, cessation and prevention of infringement, recall or destruction of infringing goods, damages and other remedies available under applicable law.
Licensing and reservation of rights
Access to this website, catalogue downloads, delivery of samples or sharing of a quotation does not transfer or license any intellectual or industrial property right. Permission arises only through a written instrument signed by an authorised MAX Lighting representative. The examples on this page are non-exhaustive, and failure to exercise a right in a particular instance does not constitute a waiver of that right.
